Including Importrant Information

In the following conditions of the contract, “the photographer” shall mean Marie Lloyd and any photographer(s) appointed by Marie Lloyd Photography. “The Clients” shall be those whose name(s) appear on the contract. If the client(s) arranges for a third party to meet the costs of this contract, the contract remains with the client(s). The due performance of the contract is subject to the conditions below and cannot be varied in any way by the client(s) unless expressly agreed by the photographer in writing.

Copyright
  • The 1988 Copyright Act assigns the copyright of the images to the photographer. It is contrary to the Act and, therefore, illegal to copy these images or allow them to be copied by any means photographic, by computer, internet or otherwise, by any person or machine other than by the photographer or his appointed agents without prior authorisation.
  • Clients can print images for personal use. (i.e. printing for home use, giving gifts to friends such as prints). You do not have permission to use the images for commercial use (i.e. selling the photos or using them for advertising). Marie Lloyd Photography still retains the copyright for all images.
Display
  • The Client(s), by signing these terms and conditions, consents to and allows the photographer to display any images covered by this contract and to generally promote the business by advertising, publicity material, websites such as Facebook, exhibitions, competitions, magazine articles, and other such media, provided that the images are used lawfully and without damage to the clients.
License and Coverage
  • The photographers shall be granted an artistic license regarding the poses photographed and the locations used. Although every effort will be made to comply with the Clients´ requirements, the photographer’s judgement regarding the location poses and number of photographs taken shall be deemed correct.
  • For bookings involving a church ceremony or at certain other venues, photographers´ movements are sometimes restricted by the minister or official in charge: photographing of parts or even all the ceremony may be restricted or prohibited, as may the use of artificial lighting. The photographer cannot accept responsibility for limited coverage in such cases.
  • Whilst the photographer shall endeavour to fulfil all the Clients´ requirements, (s)he cannot be held responsible for the non-availability of subjects or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain specified shots.
  • Once details have been confirmed, clients may only make alterations to the booking at the photographer’s discretion. If the photographer is unable to accommodate alternative arrangements (such as a change of ceremony date or venue), the photographer is not liable to compensate the client(s) in any way whatsoever.
  • The photographer is the only authorised and official photographer for your wedding day.
  • The photographer cannot be responsible for unusable shots caused by distractions from the client’s guests (e.g., eyes pointing in multiple directions or closed) and any other circumstances beyond the photographer’s control.
  • Pre-ceremony shots with one client, also known as bridal or groom preparation, commence around two hours before the ceremony.
  • Where a second shooter has been booked, Pre-ceremony shots of the second client begin two hours before the ceremony. They are covered by one photographer unless otherwise agreed in advance.
  • Full-day Wedding Photography coverage includes evening coverage. Evening coverage begins with speeches until the first dance. Evening coverage ends at 9 pm even if the first dance has not been performed. If the first dance has not occurred by 8:45 pm, the photographer will take reasonable steps to remind the clients that coverage will end at 9 pm.
  • If your package does not include full-day coverage, your coverage times will be agreed upon in advance with your photographer.
Image Reproduction
  • Owing to photochromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. The photographer will endeavour to achieve a pleasing overall colour balance based on natural flesh tones when processing images.
  • It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable.
  • On their own behalf, and on behalf of the subject, the Client’s acknowledge that they are familiar with the Photographer’s portfolio and is requesting Services with knowledge of the Photographer’s style; that Photographer’s work is constantly evolving; that Photographer’s services are of unique and artistic nature; that the photos may be different from photographs taken by the Photographer in the past; and that in creating the photos, the Photographer shall use his/her artistic judgement to create images consistent with his personal vision of the Event, which vision may be different from the Client’s and the Subject’s vision of the Event. Accordingly, the Client (s) acknowledges the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.
  • Due to computer monitor limitations, it is understood that images may appear differently according to each monitor’s specifications and that prints will not match images rendered on any particular computer monitor.
  • All print and presentation sizes quoted are approximate and subject to the photographers’ discretion.
  • Images take between 6-8 weeks from the date of the wedding to be ready for viewing, during busy periods such as the Summer images may take longer.
  • All images will be adjusted for exposure, colour, brightness, contrast, sharpness, etc to the
    Photographers taste. The Photographer’s judgement regarding these corrections shall be deemed correct.
  • Photographs will not have any retouching, such as digital manipulation. Retouching includes but is not limited to additional skin softening/smoothing, correction of hair/makeup/clothing, removal of objects from a scene, swapping a face from one image to another, environmental effects, reflections in glasses, teeth whitening, brightening of eyes, and bodily enhancements. Retouching can be purchased as an additional cost via a retoucher, the photographer does not provide this service.
Albums & supplied prints
  • Marie Lloyd Photography takes the utmost care while producing albums and supplied prints. Our products are subject to rigorous quality inspections and are dispatched in perfect condition. On receiving our product(s) the client(s) will have seven working days to report any fault or problem due to shipping or handling. Marie Lloyd Photography will rectify any fault free of charge during this time period. Faults reported outside seven working days will be subject to costs.
  • Packages that include an album should be ordered within three months of the client(s) receiving their images online. After twelve months, any increase in album costs by the album manufacturer or the photographer made after the twelve months have lapsed will be passed on to the client(s).
Storage of Images
  • Original digital images are kept on an active file for twelve months, after which time they may be deleted unless expressly stated otherwise by the Photographer. All digital negatives (computer files) remain the property of the photographer. If purchased, the photographer may supply a copy of the edited images to the client(s) for their own non-commercial use.
  • You will have access to an online gallery which contains all the images supplied for your wedding for 18 months. It is recommended you download all your images in high resolution before your gallery is terminated as retrieval of your images after 18 months cannot be guaranteed.
Photograph delivery
  • The selection of delivered photographs by the photographer is final.
Payment and Prices
  • A non-refundable booking fee of £300 (covers the associated costs with the booking and cannot be refunded) is required to secure the photographer’s services for the day, with the balance due 6 weeks prior to the event.
  • Print prices are subject to change without notice.
Force Majeure
  • Whilst every care is taken, this contract is subject to alteration or cancellation by the photographer owing to any cause(s) beyond his / her reasonable control, i.e. Act of God, Victim of crime, Fire, War, Road closure etc.
Cancellation
  • In the event of cancellation by the photographer, or in the highly unlikely event of total photographic failure, the photographer´s liability shall be limited to a full refund of any booking fee and other fees paid. Re-shoots may be arranged if practicable but the photographer will not be responsible for any further costs.
  • The photographer will endeavour to organise another photographer in the unlikely event that (s)he is unable to attend your booking.
  • In the unlikely event that only one of your booked photographer’s is unable to attend reasonable steps will be taken to find a suitable replacement however one photographer will be deemed able to cover the event.
  • If the client(s) should have to cancel a booking, the following cancellation fees will become due immediately:
  • The booking fee is non-refundable unless in the cooling off period of 14 days, this period begins once the booking fee has been paid. During this time the Contract can be cancelled without penalty and for any reason.
  • Cancellations made within four months of the wedding incur the full cost of the photographic service booked. There will be no charge for optional extras.
  • Where the photographer is able to re-book the date with an equivalent booking, the cancellation fee will be reduced to the non-refundable booking fee only and any additional cancellation fees already paid will be refunded accordingly.
  • In the event of postponement, then at the discretion of Marie Lloyd Photography and subject to availability, monies other than the booking fee may be applied to the new wedding.
  • It is essential to inform the photographer as soon as possible of any changes of venue, times, or contact details etc.
  • Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation.
Harassment
  • The Photographer will not tolerate verbally or physically abusive behaviour of the Client (s) or guests of the Event. If the Client (s) is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of their guests damages the equipment of the Photographer, it will result in the early or immediate departure of the Photographer. The Client (s) understands that in such an event, no refunds will be granted.

Important information

  • Full Day Wedding Photography starts 2 hours before the ceremony time and finishes around 30 minutes after the first dance or 9 pm whichever comes first.
  • The booking fee covers the associated costs with the booking and cannot be refunded if the date is cancelled.
  • I will photograph sparklers and smoke Bombs being used by you and your guests but you and your guests are responsible for their safe use and coordinating the use of sparklers and smoke bombs during your wedding for any photographs.
